The Naval Surface Warfare Center, Carderock Division (NSWCCD) has a requirement for continued technical assistance in development of software to provide the Navy with linear frequency-domain analysis tool to allow users to explore threat space of UNDEX events. The set-aside for small business concerns has been dissolved. The NAICS code is 541330. In support of this effort, NSWCCD intends to negotiate a non-competitive procurement using Simplified Acquisition Procedures, and award a Firm Fixed Price purchase order to Weidlinger Associates, New York, NY. Weidlinger Associates developed and controls the proprietary code, ADQUES. No other firm can obtain the proprietary code within the time and funding available that will allow for the successful completion of this task. In addition, no other contractor has the capability to make potentially needed enhancements to the code. The requirement cannot be revised to allow sources to compete, as the ADQUES code has been identified by the NAVY as the only tool suitable for meeting the requirements specified in the SOW. This code was previously procured from WAI on a non-competitive basis. To award to any other contractor would increase costs, duplicate effort and require additional time. Interested parties may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all responses received by 31March 2010 will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
