This contract action will be accomplished using Other Than Full and Open Competition under the authority of FAR 6.302-5(b)(4), Sole Source awards under the 8(a) Program--15 U.S.C. 637 and the Partnership Agreement dated 29 December 2009 between the U.S. Small Business Administration (SBA) and the Department of Defense (DOD). As part of the project to reduce risk of gate failure and increase protection to the downstream public, the contractor shall provide all labor, supervision, tools, transportation, equipment, and materials necessary to design and replace the outlet works butterfly gates (low flow gate controllers) at Ray Roberts, Ennis, Texas.
