RECOVERY – Leaking Underground Storage Tank (LUST) Project – Anchor 7 Ranch (SANC036) Lust Site

THIS NOTICE IS PROVIDED FOR INFORMATION PURPOSES ONLY THIS OPPORTUNITY IS AVAILABLE ONLY TO THE EXISTING EPA CONTRACT-HOLDER THAT HAS BEEN AWARDED A LEAKING UNDERGROUND STORAGE TANK (LUST) REMEDIATION IN INDIAN COUNTRY CONTRACT (EP-W-07-104) The purpose of this Work Assignment is to obligate $5,000.00 for the eligible tribal LUST San Carlos Anchor 7 Ranch (SANC 036) project. The period of performance for this work is from December 14, 2009 to September 28, 2011. Site activities will include the sampling and analysis of soil and potential groundwater, if encountered. In addition, all USTs' associated piping and other related equipment shall be removed from the site to facilitate adequate sampling. Between 20 to 30 cubic yards of soil may be removed from this site. This work assignment may be amended with additional funding for additional site assessment activities, if necessary. The site is located on San Carlos Apache Tribal Trust Land near San Carlos, Arizona in Gila County. The American Recovery and Reinvestment Act (ARRA) contains specific acquisition requirements that must be met when using appropriated funds from the Act, including the need for acquisitions to be in accordance with the FAR and, to the maximum extent practicable, awarded as fixed-price (FP) contracts using competitive procedures. However, the Office of Management and Budget's guidance allows for the use of other than FP contracts. Although the Agency's Office of Underground Storage Tank (OUST) contracts were not awarded as FP contracts, each contract structure was selected to provide the contractor with the greatest incentive for efficient and economical performance, given the types of services to be performed. The existing OUST contracts have sufficient qualified acquisition personnel to provide appropriate contract administration and oversight to monitor contract performance to mitigate the Government's risk. In order to meet the requirements of the Act in the most prudent business manner within the time constraints imposed, existing OUST contracts are the most appropriate contractual vehicles consistent with Agency plans that promote the goals of the ARRA.
