NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT. THIS IS NOT A REQUEST FOR COMPETITVE PROPOSALS. The Bureau of Indian Affairs (BIA) intends to enter into a sole source Firm-Fixed Price contract with Alligare for Magnacide H (Acrolein) aquatic herbicide for canal irrigation purposes under the authority of FAR 13.501(a) for its Wapato Irrigation Project. The Government anticipates the award of a firm fixed price commercial item contract in the amount of $499,800 for these supplies, which are to be delivered to Wapato, Washington, with an initial delivery due in April 2021 and a second delivery no later than 6 months after award. Anticipated award date is on or around March 10, 2021. Below is a summary of the quantities required: Below is a list of the line item numbers and quantities: Magnacide H (Acrolein) Qty 29,400 lbs. freight, per lb. qty. 29,400 lbs. hazmat fee, per lb., qty. 29,400 lbs. The irrigation canals where this product is to be applied are located on reservation land owned by the Yakama Nation. The Yakama Nation has determined that Magnacide H is the only acceptable herbicide that may be used on its reservation lands. Alligare is the incumbent contractor and intended sole source recipient and has proven successful experience and expertise providing this product in the past and is the sole authorized distributor designated by the manufacturer of Magnacide H, Baker Hughes. Distribution of this product by other than the manufacturer's designated authorized distributor is expressly prohibited by the manufacturer. No solicitation is available and no technical questions will be answered for this requirement. The NAICS code for this acquisition is 325320. If a firm believes that BIA should not pursue this procurement, it should submit a capability statement and pricing information for the requirement by 5:00pm EST on March 9, 2021.
