26--Award/Justification And Approval for Replacement Inflatable Bladders for Pneumatic Crest Gate System

This contract action was accomplished using other than competitive procedures because there is only one responsible source and no other supplies or service will satisfy agency requirements (FAR 6.302-1). See posted J&A for further information. THIS NOTICE IS FOR INFORMATIONAL PURPOSES ONLY. THE J&A IS POSTED IN ACCORDANCE WITH FAR 6.305(a) AVAILABILITY OF THE JUSTIFICATION. The US Army Corps of Engineers, Rock Island District, has awarded a contract for replacement inflatable bladders for the pneumatic crest gate system at Saylorville Dam Spillway on a sole source basis in accordance with the statutory of 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Service Will Satisfy Agency Requirements. The US Army Corps of Engineers, Rock Island District, has entered into a firm fixed-price contract with Obermeyer Hydro Accessories, Inc. of Wellington, CO. Obermeyer Hydro Accessories, Inc. is the only company producing such bladders, produced the original bladders for the inflatable gate system at Saylorville Dam Spillway, and the bladders are part of an Obermeyer patented system (US Patent 7,114,879B2). The NAICS code for this procurement is 326291 with a size standard not to exceed 500 employees.
