On June 24, 2004, Federal Prison Industries, Inc. (FPI) posted a “good faith” notice in the Federal Business Opportunities (FedBizOpps) regarding the change in the Federal Supply Classification (FSC) Code of AM amplifiers. The notice stated that FPI’s customer assigned a different classification code to the AM amplifier and it was transferred to FSC code 5996 - Amplifiers. At that time, FPI did not provide products in this FSC code. The AM amplifier that will be produced by FPI is the same as the item previously produced by FPI, with slight modifications to replace obsolete parts. Therefore, it is not different in function from the previous amplifier classified in FSC code 5895. For these reasons, FPI believes the AM amplifier classified in FSC 5996, does not meet the definition of a “new product” set forth by FPI’s expansion guidelines. FPI received no comments from interested parties regarding this proposed production within the 21 days allowed as stated in the June 24, 2004 FedBizOpps notice. Therefore, AM amplifiers will be classified in FSC code 5996 and not be considered a “new product” for FPI.
