This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT using Federal Acquisition Regulation FAR Part 13.5, Test. Program for Certain Commercial Items. This will be an acquisition under the authority of the test program for commercial items section 4202 of the Clinger-Cohen Act of 1996. The US Army Research, Development and Engineering Command Contracting Center, Aberdeen Installation Contracting Division, 4118 Susquehanna Avenue, Aberdeen, MD 21005 has a requirement to procure the following from Bittware Inc., in support of Aberdeen Test Center, located at Aberdeen Proving Ground, Maryland 21005. CLIN 0001 Bittware SY3U-ATC-004 Ballistic Digitizer, 32 channel system consisting of 21 slot chassis, controllers, time-code, clock, triple mode digitizers, modules, discs and cables. 2 each. The Government intends to award a firm-fixed price sole source purchase order to Bittware, Inc. 9 Hills Ave. Concord, NH, 03301. The proprietary software is only available from Bittware, Inc. The proprietary software was developed to control this specific instrument. Substitution of another similar instrument at this time will render the present controlling software useless. Also major wiring modifications would have to be made to accommodate any differences in I/O configurations. The associated North America Industry Classification System (NAICS) Code is 334418 and the Business Size Standard is 500. All responses received within 10 days after date of publication of this notice will be considered by the Government. A determination by the Government not to compete this proposed purchase order based upon responses to this notice is solely within the discretion of the Government. Interested persons may identify their interest and capability to respond to the requirement no later than 9:00 AM EDT, August 30, 2010. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements.
