The Defense Occupational and Environmental Health Readiness System Hearing Conservation (DOEHRS-HC) of the TRICARE Management Activity (TMA) has a requirement to request procurement assistance in obtaining services classified as OCI Category 3 Product Support via a Sole Source acquisition. The statutory permitting other than full and open competition is 10 U.S.C.2304(c)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies and Services Will Satisfy Agency Requirements. The software provided with the Benson CCA-200 Audiometer is proprietary to Benson Medical Instruments, and can only be modified by Benson Medical Instruments Inc. When the Benson CCA-200 Audiometers were purchased, a full and open competition on the commercial market was held for that effort. The Benson CCA-200 Audiometer is a commercial off-the shelf (COTS) product. The audiometer was selected in an openly competed contract in 2007. The current procurement effort is a software change that is required to meet Department of Defense (DoD) password-length requirements. As this COTS product was selected for the DoD, and the COTS product is produced by Benson Medical Instruments, Inc., the DoD will need to contract with Benson Medical Instruments, Inc. to provide this update. Any firm that believes it can provide the services required is invited to submit a written notification to the Contracting Officer within 15 calendar days from the date of this publication of this notice. Supporting evidence must be provided in sufficient detail to demonstrate the firms ability to provide these services.
