Description
The U.S. Department of State intends to award a noncompetitive contract to Copyright Clearance Center (CCC) for an Annual Copyright License. Copyright Clearance Center (as the Reproduction Rights Organization for the U.S.) is the only organization that provides this type of broad coverage license for copyright compliance. This purchase will be made as an Other than Full and Open Competition as authorized by 41 USC 253(c)(1), FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements". The anticipated award date is 13 APR 09. This notice is neither a request for competitive proposals nor a solicitation of offers. A determination by the Government not to compete this requirement is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The justification for this sole source procurement is to continue mission support by utilizing this service for compliance with all U.S. copyright laws. The Annual Copyright License enables Government employees to lawfully reproduce excerpts from the titles in CCC's repository, in print and digital formats; cover information reuse and distribution within the Department by all U.S.-based employees; use CCC's multinational licenses for employees based outside the U.S., and; reduce the burden of tracking and managing content use throughout the Department and simplify the royalty payment process. This will lessen the cost and burden to the Government by allowing the Department to make a single, annual payment to CCC instead of obtaining individual permissions to numerous publishers for each work used. The Government has researched this requirement and found that Copyright Clearance Center is the only organization providing this service in the U.S.
