B--Notice of Intent to negotiate and award a cultural resource site monitoring project on a sole source basis under the authority of FAR 6.302-1(a)(2).

The U.S. Army Corps of Engineers (USACE) - Omaha District currently has a proposed project for cultural resource site monitoring of lands currently owned by the USACE that are within the exterior boundaries of the Crow Creek Indian Reservation in Hughes County, South Dakota. USACE - Omaha District intends to solicit and negotiate the proposed project on a sole source basis with the Crow Creek Sioux Tribe which is a sovereign government. The work is required under Public Law 89-665, National Historic Preservation Act of 1966 as amended. Cultural resource site monitoring includes historic properties and traditional cultural properties. Performance of the work requires the expertise of the Crow Creek Tribe's cultural practices associated with the area surrounding Lake Sharpe and permission from the Crow Creek Tribe to access any land within or through their Tribal boundaries. This project is being processed under the authority of FAR 6.203-1 because of the need to access tribal lands and the fact that traditional cultural properties are unique to each cultural entity and or Tribe; therefore, no other entity can speak on behalf of a Tribe. The notice of intent is not a request for proposal; however, in accordance with Federal Acquisition Regulations, responsible sources may submit a capability statement, proposal or quotation which shall be considered by the agency.
