Supplemental Guide Other Transactions Agreements for Prototype Projects under 10 U.S.C. 2371b-Intellectual Property Considerations

*********SPECIAL NOTICE******* The U.S. Army Materiel Command has reviewed the Office of Secretary of Defense, Other Transactions Agreements (OTAs) Guide to determine how to provide streamlined guidance for obtaining IP when using OTAs. AMC efforts resulted in a condensed version of the OSD OTA Guide for Prototype Projects to help the AMC Enterprise in support of Acquisition programs. The attached "Supplemental Guide Other Transactions Agreements for Prototype Projects under 10 U.S.C. 2371b-Intellectual Property Considerations" is provided for use by all Life Cycle Management Commands, Engineering Centers, and AMC Contracting Activities. The guide contains no new policy, it is a summary of existing OSD policy. The purpose of the guide is to help alleviate the challenges procuring teams encounter during the initial phases of an OTA prototype project. In the coming months, additional IPTs will work to provide IP strategies in a Phase III guide (RFP Sections L & M Guide) which will reflect Technical Data Package requirements for competitive acquisitions. This document is intended to be guidance only, and not construed for use as Policy or Regulatory requirements. No industry comments are solicited or required as a result of this Notice.
