JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity: Department of Veterans Affairs Office of Acquisition Operations Acquisition Business Service 1776 I St., NW Washington, DC 20008 2. Description of Action: This Justification and Approval (J&A) for Other Than Full and Open Competition is executed by the Acquisition Business Service (ABS) on behalf of Human Resources and Administration (HR&A), Office of Administration (OA), Space and Renovation Service (SRS). The proposed sole source action is for a one-year Time and Materials (T&M), Indefinite Delivery, Indefinite Quantity (IDIQ) contract for office furniture design, layout, and reconfiguration services with CC&C Management Services, 4405 East West Highway, Suite 108, Bethesda, Maryland 20814. 3. Description of Supplies or Services: The objective of this contract is to obtain office furniture design, layout, and reconfiguration services in support of HR&A, OA, SRS so that they are able to successfully achieve the mission of reducing VA's footprint in Washington, DC through the systematic relocation of several VA offices into existing and available VA office space within Washington, DC. Specifically, three (3) current VA locations are being relocated into four (4) existing VA offices. OA, SRS requires contractual support to execute design, layout, and reconfiguration services for existing office furniture to successfully complete its mission to adequately support the relocation of three (3) Washington, DC based offices. The Contractor shall be required to survey the existing office furniture, quote and provide ancillary product needed to complete the design, properly reconfigure existing office furniture to VA's specifications, disassemble and reassemble the office furniture as required, remove and prep for excess the necessary furniture components, refurbish portions of the existing office furniture as needed, reinstall as necessary, and dispose of all trash produced at VA offices located at the following VA sites: 1. Department of Veterans Affairs Central Office (VACO) 810 Vermont Avenue Washington, DC 20420 2. Department of Veterans Affairs 1575 I St., NW Washington, DC 20005 3. Department of Veterans Affairs 425 I St., NW Washington, DC 20001 4. Department of Veterans Affairs 90K St., NW Washington, DC 20001 VA contemplates awarding an Indefinite Delivery, Indefinite Quantity (IDIQ), firm fixed price contract resulting from the solicitation. The total estimated maximum value of this requirement is $400,000. The minimum order limit will be set at $100.00. The period of performance shall run for twelve (12) months from the date of award. There are no option year periods for this contract. 4. Statutory Authority: The statutory authority permitting other than full and open competition for this acquisition is 41 U.S.C.3304(a)(5), "Authorized or Required by Statute", as implemented by FAR 6.302-5. For this action, 38 U.S.C. 8127(c), known as the Veterans First Contracting Program provides the authority to directly contract with a Service-Disabled Veteran-Owned Small Business (SDVOSB) or a Veteran-Owned Small Business (VOSB). 5. Rationale Supporting Use of Authority Cited Above: The proposed source for this acquisition is CC&C Management Services, 4405 East West Highway, Suite 108, Bethesda, Maryland 20814. CC&C Management Services, LLC is a certified SDVOSB and is technically qualified to execute furniture layout, design, and reconfiguration services under NAICS code 541410, Interior Design Services. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. Consistent with the guidelines of the Veterans First Contracting Program, the proposed action described herein will be synopsized on the Federal Business Opportunities Page in accordance with FAR Part 5. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. All future requirements will be handled on a case-by-case basis to determine any future acquisition strategy. 8. Market Research: Market research was conducted by searching the VetBiz.gov database on November 2, 2012 to determine if CC&C Management Services, LLC is a SDVOSB. This search concluded that CC&C Management Services, LLC is registered and certified and qualifies as a SDVOSB in accordance with the federal small business size standard for the applicable North American Industry Classification System Code 541410, Interior Design Services. It was verified on December 10, 2012 that CC&C Management Services, LLC is registered in the System for Award Management (SAM) database and is eligible to receive a Government contract. The technical experts from OA SRS have determined that CC&C Management Services, LLC is technically capable of meeting the Government's requirements for this effort. 9. Other Facts: The Procuring Contracting Officer has determined that this proposed action meets all the requirements of 38 U.S.C. 8127(c). This acquisition is below the $5,000,000.00 threshold, CC&C Management Services, LLC is a responsible SDVOSB for performance of the services herein, and the proposed contract can be awarded at a fair and reasonable price. 10.
