P--Award of Contract for JP8 Fuel Spill

This contract action was accomplished using other than competitive procedures because there is an unusual and compelling urgency and a delay in award would result in serious injury, financial or other, to the Government (FAR 6.302-2). See posted J&A for further information. A Contract was awarded on 17 Aug 2009 for the immediate containment and cleanup of a JP8 fuel spill that occurred at the Utah Air National Guard Base. Awarding the contract without utilizing full and open competition was justfied as in the best interest of the government based on the urgent need to contain and clean up hazardous fuel that was leaking into an adjacent canal and surrounding soil. Harm to the environment and government property would have resulted had a contractor not been called immediately to contain and clean up the fuel.
