This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subart 12.6 and guidance of FAR 13.5 as supplemented with additional information included in this notice. This announcement constitutes the ONLY solicitation and no other solicitation document will be issued. This solicitation is issued as a Request for Proposals number N61339-08-P-0157. This number is for tracking purposes only. Solicitation documents and incorporated clauses are those in effect through Federal Acquisition Circular 2005-26. This procurement will be processed in accordance with FAR Part 12. The North American Industry Classification System (NAICS) is 334611 – Software Reproducing. The SBA size standard in number of employees is 500. Naval Air Warfare Center, Training Systems Division (NAWC TSD) intends to contract, on a NON-COMPETITIVE basis, with Loyola Enterprises, Inc. (hereinafter “Loyola”), 2984 S Lynnhaven Rd, STE 101, Virginia Beach, VA 23452-6723 for the purchase of qty 11 Creator Terrain Studio and qty 1 Terra Vista DART Maintenance Renewal for periods 9/16/08 – 8/31/09 and 8/16/08 – 8/31/09 respectively. The proposed contract action resulting from this synopsis/solicitation for a commercial product is the Government’s intent to solicit and negotiate with only one source under the authority of FAR 6.302-1, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” Interested persons/parties may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within three (3) days after date of publication of this synopsis/solicitation will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement, and for informational purposes of future procurements. [email protected] SOLE SOURCE JUSTIFICATION The NAWC TSD ISEO lab has previously purchased licenses for the aforementioned software and the software developer, Loyola, is the only source available from which to obtain the maintenance to continue to support the existing, operationally necessary, software applications. The estimated cost of qty 11 Creator Terrain Studio and qty 1 Terra Vista DART Maintenance Renewal for periods 9/16/08 – 8/31/09 and 8/16/08 – 8/31/09 respectively is less than $11,260.00.
