AFSC/OL:H/PZIMB Services and Commodities Section, Hill AFB UT issues this solicitation with intent to award to Beckman Coulter, Inc. (Cage Code 80740) on a sole source basis to procure Calibration, Inspection, & Repair Services for two (2) Liquid Particle Counting Systems (LPCS). This is a sole source procurement conducted in accordance with FAR 13.106-1(b)(1). Beckman Coulter is the only source that possesses the data rights to perform the calibration, inspection, and repair services on the HIAC LPCS equipment in accordance with Original Equipment Manufacturer (OEM) specifications as the corporation merged with the Hach Company who was the OEM of the HIAC LPCS equipment. If these maintenance services were to be obtained from a source other than the OEM and that did not have the appropriate data rights to service the HIAC LPCS equipment, not only would all OEM warranties on the equipment be voided but the Government would run the risk of equipment malfunctions. Therefore, the calibration, inspection, and repair services which are needed to ensure the HIAC LPCS equipment functions properly have to be solicited on a sole source basis from Beckman Coulter. Other sources who believe they are capable of providing the Calibration, Inspection, & Repair Services for two (2) Liquid Particle Counting Systems may submit a capability statement and quotation which shall be considered by the agency if received prior to the closing of this solicitation. The Contract Data Requirements Lists listed in Section J of this solicitation (See Exhibit) have been designated as export controlled documents. Potential offers must provide the Government point of contact with a current Form DD 2345 - Militarily Critical Technical Data Agreement to gain access to the Contract Data Requirements.
