The proposed contract action is for commercial supplies or services for which the Government intends to solicit and negotiate with only one source under authority for FAR 13.106-1(b)(1). Interested persons may identify their interest and capability to respond to the requirement. This notice of intent is not a request for competitive proposals. However, the Government will consider all responses received within ten days after date of publication of this notice of intent. A determination by the Government not to compete this proposed contract action is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. TK20, Inc. is considered the only vendor who can supply the required software maintenance services to support the existing TK20 system infrastructure used by NDU facilities. Specifically, TK20, Inc. is the only designer, producer and authorized provider of software updates and patches supporting the TK20 system infrastructure. Furthermore, the warranty supporting NDU’s TK20 system architecture will be voided through the use of unauthorized software maintenance providers. TK20, Inc. is the sustaining vendor and it is the proprietary developer of the complex software maintenance now required.
