(JUL 2013) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Lowest Price Technically Acceptable (LPTA). (1) Technical: Technical acceptability will be based on your ability to provide a quote that meets the salient characteristics of the item. a) Offers must meet or exceed the specifications in the solicitation and any subsequent amendments. Quotes must list the manufacturer and part number and must be accompanied by literature and/or a brochure including photographs and/or drawings. The descriptive literature must demonstrate how the proposed item meets the salient characteristics of the item and failure to include such descriptive literature with the quote will render the quote technically unacceptable. The agency will evaluate the proposed product by comparing its salient characteristics listed in the descriptive literature with the salient characteristics provided. b) Past Performance: Quotes must provide evidence that it has successfully performed a minimum of three (3) contracts for the same or similar services within the past (2) years to include contract type, contract number, contract value, point of contact name and telephone number, and the type of service provided. Past Performance will consist of Questionnaire (attachment). Award will be made on the basis of the lowest evaluated price that meets or exceeds the acceptability standards for non-cost factors. Offerors shall submit the following information with their offer: 1) TECHNICAL. The Technical factor consists of three separate elements: Compliance/Exceptions, Product Information and Past performance. Technical information will be rated either acceptable or unacceptable. Each element must be rated acceptable to receive an overall acceptable technical rating. Offers must separately address each element to be considered responsive to this solicitation. a) Compliance / Exceptions - On a separate sheet of paper, identify any "exceptions" to the specifications and state precisely how the offered supplies/services differ from the applicable specification paragraph(s). Failure to comply with the submittal requirements of this paragraph may result in rejection of the offer. b) Product Information - Submit duplicate copies if any literature is provided with the offer. Data displaying more than one model or size shall be clearly marked so as to indicate the specific item being offered. It will be presumed that the offeror intends to meet all of the specifications, regardless of product information provided, unless the offeror specifically notes its exception. c) Past Performance. Completed Past Performance Questionnaire. 2) PRICE. a) Proposed pricing shall be provided as a unit price for all Line Item Numbers. (b) Options. N/A. (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer?s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (a) Descriptive literature, as used in this provision, means information furnished by a bidder, such as cuts, illustrations, drawings, and brochures, that shows a product's characteristics or construction or explains its operation. The term includes only that information required to evaluate the acceptability of the product and excludes other information for operating or maintaining the product. (b) Descriptive literature is required to establish, for the purpose of evaluation and award, details of the product offered that are specified elsewhere in the solicitation and pertain to significant elements such as- (1) Design; (2) Materials; (3) Components; (4) Performance characteristics; and (5) Methods of manufacture, assembly, construction, or operation. (c) Descriptive literature, required elsewhere in this solicitation, shall be- (1) Identified to show the item(s) of the offer to which it applies; and (2) Received by the time specified in this solicitation. (d) If the bidder fails to submit descriptive literature on time, the Government will reject the bid, except that late descriptive literature sent by mail may be considered under the Late Submissions, Modifications, and Withdrawals of Bids provision of this solicitation. (e) If the descriptive literature fails to show that the product offered conforms to the requirements of the solicitation, the Government will reject the bid. Performance of this contract will require the contractor to submit electronic invoices for payment, see below. Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP). "Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. (d) Required Assurance. The offeror must provide written assurance to the Indian Affairs that it will comply, or has, complied fully with the requirements of this clause. It must do this before Indian Affairs awards the Buy Indian contract, and upon successful and timely completion of the contract, but before the Indian Affairs Contracting Officer (CO) accepts the work or product. (e) Non-responsiveness. Failure to provide the information required by paragraphs (c) and (d) of this clause may cause Indian Affairs to find an offer non-responsive and to reject it. (f) Eligibility. (1) Participation in the Mentor-Protege Program established under section 831 of the National Defense Authorization Act for Fiscal Year 1991 (25 U.S.C. 47 note) does not render an Indian economic enterprise ineligible for contracts awarded under the Buy Indian Act. (2) If a contractor no longer meets the definition of an Indian economic enterprise after award, the contractor must notify the CO in writing. The notification must include full disclosure of circumstances causing the contractor to lose eligibility status and a description of any actions that the contractor will take to regain eligibility. Failure to give the CO immediate written notification means that: (i) The economic enterprise may be declared ineligible for future contract awards under this part; and (ii) Indian Affairs may consider termination for default if it is in the best interest of the government.
