The offeror must complete the annual representations and certifications electronically via the ORCA website at http://orca.bpn.gov. After reviewing the ORCA database information, the offeror verifies by submission of this offer that the representations and certifications currently posted electronically at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including business size standard applicable to the NAICS code referenced for this solicitation), as of the date of this offer and are incorporated in this offer by reference (see FAR 4.1201); FAR 52.212-4, Contract Terms and Conditions – Commercial Items, applies to this acquisition. 52.212-2 EVALUATION—COMMERCIAL ITEMS (JAN 1999) (a). The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Teaming/Subcontracting Relationships. If an Offeror’s quote includes Teaming Partners or Subcontractors, then the Offeror is required to supply to the Government, along with its quote, a copy of the Teaming Arrangement or other document that identifies which partner/subcontractor shall be responsible for performing which requirements. The Government will evaluate quotes based upon Low Price Technically Acceptable method. In performing the evaluation, the Government will make a determination if the offered product(s) is considered Technically Acceptable. To do this, the Government may consider such aspects as delivery, past performance, price, special features, administrative costs, etc. Special RFQ Instructions: (1) Quote shall be submitted under Open Market Only. (2) Quote shall include GSA order 4THO21063517. (3) Quote must be valid for 30 calendar days after submission. (4) New equipment only, NO remanufactured products, and NO gray market items. Ensure that all items will be covered by the manufacturer’s warranty. (5) Quote per specifications requested. If an item has been discontinued or is end of life, annotate quote referencing as such then quote an equal or better replacement for the item. (6) Quote is to include all fees, including shipping or freight costs. (7) Provide on quote the estimated ETA, number of days, delivery can be expected after receipt of purchase order. (8) No partial shipments unless specifically authorized at time of award. (9) All services and products provided in response to this requirement shall comply with Section 508 of the Rehabilitation Act of 1973 (29 U.S.C . 794d) and the Architectural and Transportation Barriers Compliance Board Electronics and Information Technical ( EIT ) Accessibility Standard (36 CFR part 1194). Quote must include statement addressing compliance or noncompliance with Section 508. (10) Quote must include verification that the product and/or service has been evaluated and validated by the NSA or in accordance with NSA -approved processes in accordance with Defense Confidentiality DCAS-1 (see also DODI 8500.2, February 6, 2003). Offeror should provide statement that CCR registration is current. (12) Failure to comply with the above instructions may result in quote being determined as non-responsive. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
