Description of Requirement The Naval Air Systems Command (NAVAIR), Patuxent River, MD, intends to negotiate and award a delivery order on a sole source basis under Basic Ordering Agreement N0001922G0009 with BAE Systems (BAE), 65 Spit Brook RD, Nashua NH 03060-6909, for the procurement of D-49/ALE-47 1x1 and 1x2 Dispenser systems for Lot Acceptance Testing (LAT) for Government and Production entities to perform testing to support Fiscal Year (FY) 2027 through FY 2030 for U.S. Navy and Other Customer requirements. 2. Sole-Source Justification This acquisition is being pursued on a sole-source basis under the statutory authority of Title 10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) Overhaul 6.103-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." BAE is the sole designer, developer, manufacturer, and integrator of the system. Consequently, BAE is the only known source with the requisite technical data, specialized knowledge, and infrastructure capable of fulfilling this requirement without causing unacceptable delays or duplicating costs. 3. Notice of Intent This synopsis is published for informational purposes only and does not constitute a Request for Proposals (RFP). A formal solicitation will not be posted. 4. Capability Statements & Subcontracting Although a sole source award is intended, interested and capable parties may submit a Capability Statement. Review Process : The Government will evaluate submitted Capability Statements to determine whether a competitive procurement strategy is feasible. The decision to compete this proposed contract action based upon responses to this notice is solely within the discretion of the Government.
